October 27, 2023 • Ellen Sinreich and ICSC presented an interactive workshop: Lease Boilerplate: Beware of What’s Hidden Within at the 2023 Law Conference in Phoenix, AZ.

So-called boilerplate lease provisions are often overlooked by one or both parties to lease negotiations at great potential risk. 

In this workshop, we delved into six of these provisions that are in practically every retail lease including: 

  • Real estate taxes

  • Radius restriction

  • Compliance with laws

  • Landlord access

  • Indemnification

  • Surrender requirements 

The speakers compared and contrasted the conflicting needs of landlords and tenants, and discussed creative solutions that balance their different concerns.
