Retail Bankruptcy

October 2, 2020 • Online Webinar — Ellen Sinreich convened a group of bankruptcy experts for the ICSC Legal Forum’s Retail Bankruptcy, a webinar about the bankruptcy arena in the time of COVID-19. 

The panelists discussed strategies that landlords and retailers are now employing when a retailer files for bankruptcy, including those designed to enable the retailer/debtor to conserve cash and those designed to enable landlords to protect the vitality and financial health of their shopping centers. 

Everyone agreed that for those landlord-tenant relationships that survive a bankruptcy, it provides a unique opportunity for both parties to modify those lease provisions that would otherwise be unduly harmful on a going-forward basis.
